The case initially filed by the FTC on August 3, 2010 has been resolved. All Defendants and the FTC have now entered into Stipulations for the Entry of Final Judgments and Stipulated Final Judgments have been entered by the Court as to all Defendants. These judgments impose substantial monetary judgments and enjoin Defendants from ever promoting “healthcare-related goods or services.”

The Receiver will now complete the business affairs of the receivership, which primarily involves the sale of Mr. Ellman’s yacht and other personal property of Defendants, and then apply for discharge by the Court.
The case initially filed by the FTC on August 3, 2010 is now close to a final resolution. The Defendants and the FTC have entered into Stipulations for the Entry of Final Judgments as to the Defendants which will impose financial judgments against the Defendants and enjoin Defendants from ever again advertising or promoting healthcare-related products.
These Stipulations were filed December 5, 2011 and remain subject to Court approval. Once approved, we will post them on this website. The Receiver will thereafter complete the business affairs of the receivership and apply for discharge by the Court.
On August 27, 2010, the court entered a Preliminary Injunction (click here) which appoints Thomas W. McNamara as the Permanent Receiver, freezes assets and prohibits Defendants from continuing various deceptive and unfair trade practices.
In connection with the hearing on the FTC's application for a preliminary injunction, set for August 27, 2010, the Receiver has filed a Status Report - click here to read. The primary purpose of this Status Report was to advise the court of the Receiver's investigation as to Michael Ellman's company, The American Mint Ltd. In an earlier motion to unfreeze funds, Mr. Ellman had contended that The American Mint Ltd was totally unrelated to Health Care One and, therefore, funds in its accounts should not be frozen. The Receiver found, however, that The American Mint, Ltd was not so unrelated and was the recipient of millions of dollars derived from HCO's business.

Receiver has filed a Preliminary Report
The Receiver has submitted a Preliminary Report to the court – filed August 10, 2010 – which you may access by clicking here.
A Temporary Receiver has been appointed over the business assets and operations of Health Care One LLC, Americans4Healthcare, Inc. and Elite Business Solutions and their respective dbas.
The Temporary Receiver has temporarily suspended the taking of any new clients and is reviewing the remainder of the business.
The Temporary Receiver was appointed in a case filed by the Federal Trade Commission in the federal court in Santa Ana, California entitled FTC v. Health Care One LLC, et al., Case No. 10-1161 JVS(RNBx). On August 3, 2010, the court issued a Temporary Restraining Order (“TRO”) which appoints the Temporary Receiver, freezes Defendants’ assets and prohibits Defendants from continuing various deceptive and unfair trade practices.

The TRO prohibits Defendants from making any false representations that (A) Defendants’ program is health insurance; (B) Defendants’ program is affiliated with or sponsored by the federal government; (C) Enrollment in Defendants’ program will result in substantial healthcare savings; (D) Consumers who enroll in the program will be able to obtain program benefits from their healthcare providers and other healthcare providers in their community; (E) Defendants will provide a full refund, subject to no or only a nominal processing fee, to consumers who submit a cancellation request before the 30-day trial period expires; and (F) any other fact material to a consumer’s decision to purchase goods or services from Defendants.
The Receiver will use this website to communicate with consumers and others regarding the receivership and we will post updates as developments merit.
Although HCO has suspended current sales efforts, you may contact the administrator of your program by calling the toll-free 800 number for that program which is listed on the back of the Enrollment Card you received with your New Member Kit. Those numbers will also be posted on this website.
